从案例分析浅谈对申请日后补交实验数据新规定的理解

Discussion on Understanding of New Provision About Experimental Data Supplemented After the Filing Date by Analyzing Cases

笔者结合各时期《专利审查指南》对申请日后补交实验数据的规定和审查情况以及具体案例分析来浅谈对新修订的《专利审查指南》第二部分第十章第3.5节的"补交实验数据所证明的技术效果应当是所属技术领域的技术人员能够从专利申请公开的内容中得到的"内涵的理解,以增强发明专利申请人和专利权人对该补交实验数据的实务可操作性。

The author discusses how to understand ＂the technical effect proved by supplementary experimental data should be gotten from the disclosure of patent application by the skilled in the art＂ of 3.5 Section of Chapter 10 of Part Ⅱ of newly amended Guidelines for Patent Examination by combining relevant defines and examination situations during different periods for the supplementary experimental data and cases analysis in order to enhance operability of the supplementary experimental data as applicant and patentee.
