摘要
《专利法》第十六条规定发明人报酬的支付义务主体是"被授予专利权的单位",当跨国公司通过其内部的知识产权管理协议造成"被授予专利权的单位"和发明人所在单位不一致时,法院应该如何确定发明人报酬支付义务主体。
Although the duty bearer of remunerative payment for the employee inventor has been literally stipulated as the patentee employer in the Article 16 of Patent Law, courts have been developing detailed judging rules in the scenario of a discordance of the patentee and the employer arranged by interior intellectual management conventions in transnational corporations.
