标准必要专利的计费模式研究——以最小可销售单元并非必要计费路径为视角

Research on Standard Necessary Patent Charging Model——With the Smallest Salable Unit is not A Necessary Billing Path as Perspective Protection

标准必要专利的收费模式是否合理的一个重要评判标准为FRAND原则。本文以高通为例,梳理了标准必要专利、FRAND原则、最小可销售单元三者之间的逻辑关系,确定了最小可销售单元并不是标准必要专利的必然计算路径,并提出具有理论支持和可操作性的不以最小可销售单元为前提的合理计费模式。

FRAND principle serves as an important criteria in judging whether a charging mode of standard essential patent is reasonable. With Qualcomm as an example, this article comes to elaborate the logical relations between standard essential patent, FRAND principles and smallest saleable unit. It is confrmed that smallest saleable unit isn’t a necessary computational path of standard essential patent, while bringing up a reasonable charging mode with theoretical basis and operability, without basing on any smallest saleable unit.
