A Study on New Issues of Intellectual Property Arising by Artificial Intelligence

人工智能的快速发展给法律制度带来了挑战,其引起的知识产权相关争议,主要体现在相关技术发明的专利和大数据财产利益保护方面。传统上基于有形产品技术方案的专利保护客体及其创造性、新颖性的理解与阐释,在人工智能时代需要一定的革新,以设定适当的专利保护标准促进技术发展。人工智能产生和管理的大数据产生的财产利益,以版权保护有一定理论障碍,从反不正当竞争法的角度对其予以某种保护是相对合理的路径。

The rapid development and broad utilization of Artificial Intelligence （AI） technology strikes present legal system including intellectual property （IP） law. As for challenges in the IP field aroused by AI - related creation, the main issue is how to set appropriate criteria of patent protection, and how to protect the legal interests of relevant parties during the process of big data collecting or exploiting executed by AI robotics. The understanding and explanation of patentability, as well as criteria of non - obviousness and novelty applied for tangible product or method creations in traditional patent system need innovation in order to protect the technological creations in the AI era; and protecting relevant interests in big data from the perspective of prohibiting unfair competition is an alternative approach.
