会流转的财产——隆林彝族财产继承习惯法研究

Assets That Could Be Transferred: The Customary Law of Inheritance in Longlin Yi Nationality

关于彝族继承习惯法的记载多见于四川大小凉山彝族,对隆林彝族习惯法的了解还几乎处于空白。隆林彝族有着悠久的历史文化和独特的纠纷处理机制。作者通过对隆林多地的彝族进行田野调查,查阅相关文献,结合隆林彝族的文化,将隆林彝族传统财产继承习惯法的面貌呈现出来,并挖掘其具有特色的财产流转制度。文章还结合现行的中国继承法,与隆林彝族继承习惯法进行对比,分析两者之间存在的张力及其原因,并提出相应的立法建议,以期能让中国继承法和隆林彝族继承习惯法进行有效的融合。

The records of inheritance customary law of the Yi nationality are commonly seen in Sichuan Liangshan Yi nationality. There is no corresponding record yet,however,on Longlin Yi nationality,which also boasts a long history and culture,with its unique mechanisms for settling disputes. This paper is attempt to recover that tradition and to find out the characteristics of its property circulation system based on field surveys of the Yi nationality of Longlin,accessible and relevant literature,and the cultural traits of the Yi nationality of Longlin. The author also compares it against the current state of China＇s Inheritance Law and analyzes the tension between the two, pointing out the reasons and putting forward relevant legislative suggestions,in order to strive for a possible integration.
