对城市治理中地方立法的思考——以《湖南省城市综合管理条例》为考察对象

Reflections on Local Legislation in Urban Governance——Taking "Regulations on Comprehensive Urban Management of Hunan Province" as an Example

城市治理走上法治化道路是必然的发展趋势,地方城市治理法治化探索既是因地制宜推进依法治国的有力举措,又为整个国家的法治建设积累了经验。2017年5月,湖南省人大常委会通过了《湖南省城市综合管理条例》(以下简称"条例"),作为全国首部省级层面综合规范城市管理和执法工作的地方性法规,《条例》在诸多方面做出了大胆探索和制度创新,为推动城市管理地方立法的发展提供了新的图景。透过《条例》同样可以透视未来城市管理地方立法的若干发展趋势。但是,由于多方面因素的影响,《条例》仍有完善的空间。

It is an inevitable trend for urban governance to take the road of ruling by law. The exploration of the rule of law in local urban governance is not only a powerful measure to promote the rule of law according to local conditions, but also accumulates experience for the construction of the rule of law in the whole country. In May 2017, the Standing Committee of Hunan Province passed the ＂Regulations on Comprehensive Urban Management of Hunan Province＂（hereinafter referred to as ＂Regulations＂）as the country’s first local regulation to comprehensively regulate urban management and law enforcement at the provincial level. The Regulations have made bold explorations and institutional innovations in many aspects, providing a new prospect for promoting the development of local legislation on urban management. Through the ＂Regulations＂, we can also see some development trends of local legislation on urban management in the future. However, due to various factors, there is still room for improvement in the Regulations.
