网络主播劳动者地位认定的困境、反思和出路

The Dilemma,Reflection and Solution of the Employee's Status Identification of Network Anchor

探讨网络主播的劳动主体地位,旨在为人工智能时代平台经济中新型劳动形态的法律定位提供些许立法建议。通过对网络主播劳动者地位认定的裁判困境解构、传统标准反思及创新出路建构,并结合网络主播的工作类型与签约模式分析可知,《关于确立劳动关系有关事项的通知》中传统劳动关系的认定标准容易受平台经济发展和主播权益保护利益衡量约束,不能全面反映平台经济的用工变化、不能完全调整主播和平台运营人之间的用工关系。网络主播劳动者地位认定在考虑人工智能时代变迁、网络平台经济发展及网络主播权益保障因素的同时,尚需立足于我国直播平台发展现实和主播权益保护现状,借鉴域外国家立法经验,构建非标准劳动者概念模型,适度扩充传统劳动关系标准,实现主播权益和平台效益的和谐共生。

To explore the appropriate labor status of the network anchor, aims to provide some reference for the legal orientation of the new labor form under the platform economy of the artificial intelligence era. Through deconstructing the judging dilemma, reflecting the traditional standards and constructing the innovative outlet of identifying the employee＇s status of the network anchor, in the meantime, combining with the analysis of the type and contract mode of the network anchor, we can clearly see that the identification standards of the traditional labor relations in the Notice on Establishing the Labor Relations are easily subject to the constraints of platform economy development and the interests of the broadcasters＇ rights and interests protection. They can＇t fully reflect the em- ployment changes in the plafform economy and can＇t completely adjust the employment relationship between the anchor and platform operators. Considering the changes in the era of AI, the development of the Internet platform and the protection of anchor＇s rights and interests, while affirm the labor status, we need to base the development of China＇s live internet broadcasting platform and thestatus quo of the anchor, drawing on the experience of others in legislation, building non-standard laborer conceptual model, appropriately expanding the traditional labor relations standard to achieve the harmony of the rights and interests of the anchor and the platform.
