推进国家监察体制改革的关键是实现反腐法治化,而实现反腐法治化必然要厘清国家监察权与行政监察权、纪检监督权、检察监督权(限于司法属性的职务犯罪侦查权)三项"子"权的关系;优化国家监察权内部监督与外部监督相互制约监督的机制,科学推进国家监察立法为反腐法治化提供制度支撑;落实人权保障理念贯穿于《监察法》、监察权运行之始终;营造"社会中心主义"参与反腐的"理性构建"镜像,运用法治思维、法治方式反腐,亦是推进国家监察体制改革反腐法治化路径的选择。
