中国基层法院司法满意度考察——以民事裁判文书为对象的实证分析

An Analysis on Judicial Satisfaction of China's Primary Court——An Empirical Study of Civil Judgment

裁判文书是司法过程和裁判结果的集中体现,民众对裁判文书的满意度直接影响着他们对司法的评价,因此裁判文书满意度是民众司法感受的集中体现之一。对诉讼参加人进行问卷调查能够比较准确地反映其对裁判文书的满意度,是司法满意度研究的重要方法之一。通过调查可以看出,不同受调查者对裁判文书的评价存在差异。对调查数据的进一步量化分析发现,受调查者的身份、对法律知识熟悉程度、诉讼结果以及裁判文书撰写水平等,都会对裁判文书的满意度产生影响,并呈现出受调查者对法律越熟识满意度越高等规律。

Judgment documents are the centralized embodiment of judicial law.The satisfaction of litigants on the judgment documents directly affects their evaluation of judiciary,thus,it is the concentrated expression of the people＇s judicial experience.In this paper,aquestionnaire on the satisfaction of 380 participants in the judicial proceedings was conducted to reflect the public opinion on judgment documents and the evaluation differences among different groups.It is suggested that,in legislation,it is important to establish the legislative democracy and expand the scope of application of legal aid system.In the judicial system,we should strengthen the interpretation of the law in trials,vigorously promote the Alternative Dispute Resolution,enhance the popularity of the litigation activities,and properly carry out the reform of the judicial documents.As to society aspect,it is important to strengthen the integration of all social strata and legal publicity.
