文章阐述了集体林地三权分置的历史沿革,分析了三权分置下集体林地所有权、集体林地承包权、集体林地经营权等3项权利的法学关系及其权能和定位,探讨了山西省集体林权流转管理现状,为下一步研究集体林权改革中存在的林权流转问题、解决生产实践难题,提供了理论参考和科学依据。

This article expounded the historical evolution of the separation of three powers of collective forest land, and analyzed the legal relationship, power and location of collective forest land ownership, collective forest land contracting fights and collective forest land management rights under the separation of three powers. The pa- per discussed the current situation of the transfer management of collective forest tenure in Shanxi Province, pro- vided a theoretical reference and scientific basis for further research on the issue of forest tenure circulation in the reform of collective forest tenure and solving the problem of production practice.
