随着4G网络的普及、无线网络的大范围覆盖以及各类手机APP的层出不穷,世界进入"移动互联"时代,科技的发展使得社会沟通更为紧密。此种背景唤醒了一种经济模式——共享经济。其商业模式可以"共享",但一旦涉及专利却只能"独占",在共享单车领域表现尤甚。分析摩拜单车在被诉直至结讼的整个过程中,就维权、确权、授权三阶段所采取的应对措施,给其他共享经济领域的企业以启示。

With the popularization of 4G network, the wide coverage of wireless network and the emergence of various types of mobile Apps, the world has entered the era of ＂mobile Internet＂, and the development of science and technology makes social communication more closely. This background awakened a long existing economic mode the sharing economy. Different from traditional economy, Sharing economy has its own unique business mode which teatures with ＂shared＂ characteristics. This is the opposite of patent with ＂exclusive＂teature, especially in sharing bicycle business.This paper analyzes the countermeasures taken by mobike in the three stages of rights protection, rights confirmation and authorization in the whole process of litigation, and provides enlightenment tor other enterprises in the sharing economy.
