《韩国版权法》中的“三振出局”制度研究及启示

Research and Enlightenment of the "Three Strikes Out" System in Korean Copyright Law

随着互联网技术的更替,新类型版权纠纷数量不断上升,许多国家纷纷引入"三振出局"版权保护制度,以加强对网络版权的保护,例如韩国在其2009年修订的版权法案中正式引入"三振出局"制度。基于国情的不同,我国若直接引入"三振出局"制度,则可能造成行政机关与司法机关的权力分配失衡、错误措施的责任主体模糊等问题。因此,应当在考察我国的著作权保护现状之下,建立符合我国国情的"三振出局"著作权保护机制:加强权利人和网络服务提供商的积极参与,适当融入"三振出局"制度,而不宜全盘引进。

With the renewal of Internet technology, the number of new types of copyright disputes has been on the rise. Countries all over the world have introduced the thine strikes out＂ copyright protection system in order to strengthen the protection of online copyright. As a major Internet power in Asian countries, Republic of Korea has also officially introduced the ＂ three strike out＂ system in its revised copyright law. Because of the differences in China＇s national conditions, the direct introduction of the ＂ three strikes out＂ system may cause imbalances in the distribution of power among administrative agencies and judicial organs, and obscure subjects of wrong measures. Under the current situation of China＇s protection of copyrights, we should form a ＂ thine strikes out＂ tection system that conforms to China＇s national conditions. By strengthening the active participation and the cooperation among network service providers, we will effectively integrate the ＂ three strikes stead of introducing it fully copyright pro- of right holders out＂ system instead of introducing it fully.
