摘要
在"互联网+"盛行的时代背景下,各种新兴形式的作品不断出现,网络游戏直播就是其中之一。大量资金投入网络游戏直播领域,使得各直播平台之间的竞争日益激烈。网络游戏相关著作权的归属和保护问题,在我国知识产权学术与实务领域都存在很大分歧。网络游戏作品通常归属于计算机作品,网络游戏画面涵盖的作品有美术作品、文字作品、音乐作品等。网络游戏直播画面和电影作品具有相似的制作方法和表现形式,可以纳入类电影作品的范畴。游戏玩家未经许可对游戏画面进行直播,属于《著作权法》中合理使用的范畴。
In the era of " Internet + " , various emerging forms of works are emerging constantly, among which broadcasting online game is one of them. A large amount of money has been invested in the field of online broad- casting game, which makes the competition increasingly fierce between live broadcasting plafforms. The ownership and protection of copyright related to online games are quite different in the academic and practical fields of intellectual property in China. The online game works usually belong to the computer works, but the dynamic pictures and the film works have similar production methods and expression forms, which should be included in the category of film works. That the game players live broadcast the works without permission belongs to the reasonable use of copyright law.
