Research on the Protection of Personal Information under Usage of Documentation in Big Data Era

传统档案管理中,对于个人信息的权益保护注重的是隐私权价值,但是面对大数据技术,消极不受侵扰与积极控制意义上的隐私权均面临适用的局限性。只有改变支配性权利诉求,确认与保护知情参与与自主决定意义上的个人信息权利,才能有效平衡档案开放利用与个人信息权益保护的关系。

In traditional management of documentation, great emphasis is put on individual’s personal right on personal information. However, under the influence of big data technology, both passive protection and active control have put great limitations to the usage of personal information data. Only by changing the method of appealing the usage right, confirming and protecting of the right of fully informed participant, can balance the relationship between fully development and usage of documentation and protection of personal information be properly balanced.
