在城镇化的大背景下,我国社会结构和城乡比例发生了巨大的变化,越来越多的人离开原来的熟人社会成为"新市民",他们的不断加入改变着城市原来的生活模式和行为状态。社区纠纷主体私法权益的处分权决定了民事纠纷是否解决以及如何解决由当事人选择,在社区解纷机制的构建中,应充分尊重当事人的合意,让当事人在纠纷解决过程中成为实际参与者和主要支配者,唯有此才能提高社区纠纷的解纷效益,实现主体利益的最大化。

In the background of urbanization, great changes have taken place in the social structure andthe proportion of urban and rural areas. More and more people are leaving their former acquaintance societyand becoming ＂new citizens＂ ,they change the mode of life and the behavior of the original city. The populationstructure of urban community is becoming more and more complex, and the types and quantities of disputes areincreasing sharply. Facing the change of community disputes, China needs to construct diversified dispute resolutionmechanism in community construction. The disposition right of the subject determines how to solve the problemis the choice of the parties. Therefore, the parties should be fully respected and become the actual participants inthe dispute settlement process. Then it will improve the community dispute resolution efficiency and realize themaximization of interests.
