论自媒体意见表达自由之边界及其限制

Boundary and Limitation of Opinion Expression Freedom on the We-Media

自媒体意见表达这个"原生态"的意见场域呈现出的信息良莠不齐、侵权频发等现象,给社会发展带来诸多负面影响。自由止于法律的边界,自媒体意见表达权利止于人格权益、国家利益、公序良俗。表达自由作为一项宪法权利而受到一定的限制有其理论背景。从道德视角审视,自由必须被科以责任;从正义视角出发,对自由的追求必须以享有有限权利为前提;从法治视角观察,出于国家利益限制表达自由也必须以法治为原则。对自媒体意见表达的规制,应从公法规制、司法引导、行业自律三个方面构建国家规制和社会规制相结合的治理机制。

There are phenomena such as incomplete information and frequent infringement in the ＂original form＂ of opinion field on the We-media, which has brought much negative impacts on social development. From the moral perspective, freedom must be subject to responsibility; from the perspective of justice, the pursuit of freedom must be premised on the limited rights; from the perspective of law, the limitation for expression freedom should be based on the rule of law for the sake of national interests. The regulation of opinion expression the We-media should be built from the three aspects： public regulation, judicial guidance and professional self-discipline to construct a governance mechanism that combines national regulation and social regulation.
