摘要
印刷出版特许权是指国王授予的行业或书籍印刷出版的垄断权,具有先占性、独有性和排他性的特征。但是在近代英国却出现大学出版社与国王的印刷商同时拥有同类书籍印刷出版特许权的特殊现象。由于双方特许权的内容和范围产生冲突,大学出版社与国王的印刷商数次对簿公堂。最终,法庭认定双方的特许权同时存在并生效。大学出版社在与国王的印刷商的斗争中逐渐成长起来。
The Franchises of printing is a monopoly right to the industry or the printing and publishingof books which granted by the king, which has the characteristics of preemptive, unique and exclusive.However, in the modern Britain, there was a special phenomenon, that university press and king'sprinters both had the franchises of printing and publishing of similar books. As the contents and scopeof the franchises of the two sides were in conflict, the university press and king's printing went to courtseveral times. Eventually, the court determined that both parties franchises existed simultaneously andeffective. The university press grew up in the competition with the king's printers.
