农村征地冲突法治化治理的问题与策略

Problems and strategies on the rule of law governance of rural land expropriation conflict

当前我国农村征地冲突法治化治理面临着法治观念不强、法律规制不完备、行政法治机制不健全、司法审查机制难以有效发挥作用等问题。农村征地冲突法治化过程中,应当遵循及时应对原则、比例原则以及多元参与原则,采取强化依法治理理念、完善征地管理法律规范、健全征地行政法治机制以及提升司法审查的效能等策略。

s At the present, the rule of law in rural land expropriation conflicts is faced with such problems as weakconcept of rule of law, imperfect legal norms, imperfect administrative rule of law mechanism, and ineffective judicialreview mechanism. In order to promote the rule of law governance of land acquisition conflicts, firstly we should followthe principle of timely response, the principle of proportionality and the principle of multi-participation. In addition, weshould explore the strategies of the rule of law in rural land expropriation conflicts from the aspects of improving theconcept of the rule of law, perfecting the system of relevant legal norms, improving the administrative rule of lawmechanism and enhancing the role of judicial review mechanism.
