消费级无人机法律规制问题研究

Research on the Legal Regulations of the Unmanned Aerial Vehicle of Consumer Level

2018年上半年我国民航局、交通部等部门发布了多条与无人机相关的政策或文件,如《无人驾驶航空器飞行管理暂行条例征求意见稿》《民航公安行政处罚裁量基准》等。但从现实情况来看,总体而言,中国消费级无人机立法仍然存在着立法滞后、效力等级低、领域空白等问题。

In the first half of 2018, the Civil Aviation Administration of China and the Ministry of Transport of the People＇s Republic of China have issued a number of policies or documents related to UAVs, such as the ＂nterim regulations on the flight management of unmanned aircraft＂ and ＂civil aviation public security administrative penalty discretion standard＂ and so on. However, from the reality, in general, China＇s consumptive UAV legislation still has many problems, such as the lagging behind legislation, low level of effectiveness, and blank areas.
