文化多样一体的法哲学探源

The origin of integrated cultural diversity from the perspective of Philosophy of Right

建立文化多样一体的法哲学范式可以为论证包容性法治提供话语体系。当前文化法哲学学科建立的重要工作是寻找和梳理其理论渊源。在法哲学上可以概括为三个方面:社会主义文化在文化体系中居于支配、主导地位,文化多样形态亦是不可缺少的;中国优秀传统文化多样一体思想集中体现为"和而不同";文化人类学关注对他者文化的借鉴和对处于弱势地位的传统文化的保护。文化的多样与一体是不可分割的两个方面,不仅要坚持文化的一体性,而且要在守牢底线的前提下,提高对文化多样性的包容程度。

Establishing a Philosophy of Right paradigm that integrates cultural diversity can provide a discourse system for demonstrating the inclusive rule of law. An important step at present to establishing the discipline of cultural Philosophy of Right is to search for and sort out its theoretical origins. In the Philosophy of Right, it can be summarized into three aspects： socialist culture is dominant in the cultural system, and cultural diversity is indispensable; the idea of Chinese excellent traditional culture and diversity is embodied in “harmony in diversity”; culture anthropology focuses on the reference to other cultures and the protection of traditional culture which is in a weak position. The diversity and integration of culture are two inseparable aspects of one thing. It is necessary not only to adhere to the unity of culture, but also to increase the tolerance of cultural diversity with maintaining maximum cultural identity and core values.
