商鞅吏治思想及其现代启示

Shang Yang's Thought of Bureaucracy and its Modern Revelation

商鞅以人性好利为基础,重视对官吏的防范治理。主张以法治吏,强调制度约束;坚持官吏选拔"唯功是举",从源头防范;深入实际,考察政绩,要求官"无宿治",讲究办事效率;建立"别其势,难其道"的监督体制。当前法治政府建设的重点是法治队伍的建设,商鞅的以法治吏思想对于政府队伍建设具有重要的借鉴意义。

Shang Yang attached great importance to the prevention and governance of officials on the basis of his humanity. He advocated law and order, and emphasized on system restraint; adhered to the criterion ＂Promotion only by merits and achievements＂ for the official selection, thus avoiding and preventing risk from the source; stick to the practical and realistic work style, and stressed on efficiency in performance reviews of government officials; and established the supervisory system and the balance of power distributed among officials. At present, the construction of the government under the law focuses on the team building for enforcing the rule of law, and Shang Yang＇s thought of ＂ruling officials by law＂ has referential significance to the construction of government administrative personnel.
