中国“工读学校”概念再思考

摘要 中国的工读学校自1955年设立以来在矫正青少年不良行为、预防青少年犯罪方面发挥了重要作用。然而相关法律法规与工读学校的发展现状存在严重不匹配现象,工读学校的法律定位没有完全厘清、相应规范标准模糊不清等,法律制度不尽完善之处已经阻碍了工读学校的良性发展。应尽快完善工读学校相应法律法规,从立法上明确"工读学校"的概念、性质、任务,促进其在法治轨道上持续、良性发展。 Since its establishment in 1955, China s work-ready schools have played an important role in correcting juvenile bad behavior and preventing juvenile delinquency. However, there are serious mismatches between the relevant laws and the development status of reformatory schools. The legal orientation of reformatory schools has not been completely clarified and the corresponding standard is not clear. These imperfect legal systems have hindered the sound development of reformatory schools. We should improve the corresponding laws and regulations for work-study schools as soon as possible, clarify the concept, nature, and tasks of “ work-reading schools” from the legislative perspective, and promote continuous and benign development under the rule of law.
