数权、数权制度与数权法研究

The Research on Data Right, Data Right System and Data Right Law

数权对人类共同生活具有不可估量的意义。本文探讨了数权的法理基础,通过与人权、物权的比较,揭示数权在法哲学上的正当性依据,从而证成数权制度创设的可能性、必要性和必然性。目前,《民法总则》《网络安全法》等对"数权"的表述仍较模糊和分散,且尚未形成数权体系和统一法理。本文初步提出了数权制度的基本构想,在此基础上,对"数权法"的立法架构提出设想和展望,以期加快推动数权立法进程,建构数字文明新秩序。

Data right is of immeasurable implication for common life of the mankind. In this paper, we discuss the legal basis of the data right and reveal the basis for the philosophical appropriateness of the data right through a comparison with human rights and property rights, so as to demonstrate the possibility, necessity and inevitability of establishing the data right system. Currently, the General Provisions of Civil Laws, the Network Security Law and other laws still describe the ＂data right ＂in an ambiguous and discrete manner. The data right system and unified legal principle are not established yet. In the paper, we preliminarily propose the basic assumption of the data right system. On this basis, we propose ideas and prospects for the legislative framework for the ＂Data Right Law＂ in or- der to accelerate the legislative process of data right and construct a new order of digital civilization.
