The Innovation Concept and Safeguard Mechanism of the Interests Compensation Mechanism for the Service Invention in Japan

论文旨在探索日本职务发明利益补偿机制的创新理念和保障机制,分析日本政府不断修订的特许法中有关职务发明规定的创新之处,阐述其在实际应用过程中对专利拥有者的保障措施。通过研究该项机制的创新对日本企业在后续发展中所展示的有效思路,为我国知识产权工作中有关职务发明的相关实践提供参考。

The purpose of this paper is to explore the innovation concept and safeguard mechanism of the interests compensation mechanism for the service invention in Japan. The paper analyzes the innovation points in the Concession Law, which has been continuously revised by the government of Japan, relate to the service invention regulations. The safeguard measures for patent holders in the course of its practical application are expounded. Through studying the effective idea that presented in the follow-up development of Japanese enterprises through the innovation of this mechanism, some reference can be provided for the practice of the service invention in China＇s intellectual property work.
