认可与执行香港法院民商事判决的新思路

A New Idea for the Recognition and Enforcement of Hong Kong Civil & Commercial Judgments

香港是国际争议解决中心。随着一带一路战略的实施,认可与执行香港法院的民商事判决变得更加重要。2006年7月14日,最高人民法院与香港特别行政区签署了《关于内地与香港特别行政区法院相互认可和执行当事人协议管辖的民商事案件判决的安排》(简称《安排》)。《安排》具有临时性,对认可与执行民商事判决的范围做了太多限制,实践效果很不理想。由于特殊的背景,不太可能通过双边协定的方式来解决香港法院判决的认可与执行问题。应该抛弃互惠原则,改为单边模式。解决香港法院民商事判决在大陆的认可与执行问题的最佳方案,是由最高人民法院制定全国统一适用的规则。

Hong Kong is an international center for dispute settlement. With the carrying out of Belt and Road Initiative,the recognition and enforcement of Hong Kong civil ＆ commercial judgments is of more importance. The Supreme People’s Court and HK SAR achieved consensus on Arrangement on Reciprocal Recognition and Enforcement of Judgments in Civil and Commercial Matters by the Courts of the Mainland and of the Hong King Special Administrative Region Pursuant to Choice of Court Agreements Between Parties Concerned（hereinafter referred to as Arrangement）through consultation and signed on July 14,2006 . This Agreement,which is temporary,has too much restriction on the recognition and enforcement of civil ＆commercial judgments and very limited application. Due to the special background,it is impossible to resolve the problem of recognition and enforcement of Hong Kong civil ＆ commercial judgments by bilateral agreement. Therefore,it is necessary to change the reciprocity principle with unilateral rule. The best way to resolve the problem of recognition and enforcement of Hong Kong civil ＆ commercial judgments is to formulate a regulation that shall be observed by all the courts in PRC by the Supreme People’s Court.
