浅谈中药老字号专有技术的法律保护

Legal protection of know-how in time-honored enterprises of traditional Chinese medicine

专有技术是中药老字号竞争和发展最为重要的内容,但其法律保护却存在诸如过度依赖专利制度、缺乏行政保护方式和企业内部保护意识淡薄等问题。针对这些问题笔者提出专利保护和商业秘密保护相结合;知识产权保护和行政保护相协调;建立专有技术保护名录等建议。

Know-how is the most important part of the competition and development of traditional Chinese medicine enterprises. However, there are some problems in the legal protection of know-how, such as over-reliance on the patent system, lack of administrative protection and weak awareness of internal protection. In response to these problems, the author proposes the combination of patent protection and trade secret protection, the coordination of intellectual property protection and administrative protection, and establishing a proprietary technology protection list.
