农村集体经营性建设用地土地增值收益分配机制探析——以甘肃省定西市陇西县为例 被引量:7

摘要 农村集体经营性建设用地入市改革试点工作于2015年正式启动。如何在法律层面构建兼顾国家、集体与个人利益的土地增值收益分配机制,最终保障农民公平分享改革成果,是此次试点的重要内容。作为试点地区之一的陇西县,结合当地实际情况,确定了土地增值收益分配机制的总体思路、基本原则和具体制度。参照陇西县的试点成果,在立法上应当从明确收益分配参与主体、确定合理的收益分配比例、规划科学有效的收益分配方式、健全完善的收益分配监督体系等几方面为切入点,构建我国农村集体经营性建设用地土地增值收益分配机制的基本框架体系。 The pilot reform of rural commercial collective-owned construction land entering land market began in 2015.How to establish a land increment benefit distribution mechanism of country, collectivity and individual at th elegal level, and to fairly protect peasants sharing of land increment benefit is the emphasis at this stage. According tolocal conditions, Longxi county works out the general thinking, basic principles and concrete systems, as one of thepilot areas. Based on the results, the legislation should start with clearing the subject of participating income distribution, making sure a reasonable income distribution ratio, planning a scientific and effective income distributionmode and establishing an excellent income distribution supervision. By these measures, we can establish the basic framework of the land increment benefit distribution system.
