"法治"这一问题始终受中外学界普遍关注并且热度不减。而司法在法治的建设中起着不可或缺的作用,随着司法改革的深化,研究司法的角色迫在眉睫。德沃金作为英美法哲学界最负盛名的法学家之一,在其后期著作《法律帝国》之中,以建构性解释为方法,整全法为制度体系,赫拉克勒斯式法官为主体所构建的法律理论发人深省。为研究司法的角色,该法律理论能够提供一个良好的理论基础。

The phrase＂rule by law＂has always been concerned by the Chinese and foreign educational world. With promoting judicial system reform,studies on the function of the judge which plays the key role in the rule of law,are significant. Ronald Dworkin is one of the famous jurists in the philosophy of law. In＂Law＇s Empire＂,he used the method of constructive interpretation,created the system of integral law and focused on the Hercules judge. To study the role of justice,the theory can provide a good theoretical basis.
