摘要
军队空余房地产租赁是我国社会经济转型期特定的产物。从法律的视角,分析和研究了军队空余房地产租赁的基本概念及相关范畴、跨军地的政策和规范文件,以及基于该政策、规范所建构的项目租赁制度,即出租人(军队)资格、租赁用途与范围、项目许可和审批、租约形式要件等内容,重点揭示其与《中华人民共和国土地管理法》《中华人民共和国国防法》等上位法之间不协调等矛盾问题。最后,对项目租赁合同的效力、合同终止或无效后承租人的利益保护问题等进行归纳,提出对策与建议。
he military’s vacant real - estate lease is the product of the specific historical period of social and economic transition in China. From the view of the law, this paper analyzes and studies the concept and related categories of leasing vacant real estate, the policies and normative documents of both the military and the local government on this issue, as well as the system of leasing based on this norm, namely, the qualification of the military subject, the use and scope of leasing, the approval and forms of the leasing, etc. and reveals their discordance with the higher laws and contradictory issues, such as the contradiction between the Law on Land Administration and National Defense Act. Finally, this paper summarizes the validity of lease contract, the interest protection issues of the lessee after the termination or invalidation of the contract, and proposes some countermeasures and suggestions.
