Review of Chinese Criminal Law Legislation in the 40 Years since the Reform and Opening-up

2018年中国改革开放迎来了40周年。40年来,中国的刑事法治建设和刑法立法取得了长足进步。1979年颁行的《刑法》是中华人民共和国第一部刑法典,1997年颁行的新《刑法》是一部较为系统、完善的法典。截至目前,1997年《刑法》已经有10部刑法修正案和13个立法解释。回顾与总结新、旧刑法前后两个20年的发展、成就及不足,有利于刑事法治在未来全面依法治国的实践中、在积极参与社会治理和人权保障方面发挥更为重要的积极作用。

China＇s reform and opening up in 2018 ushered in its fortieth anniversary. In the past 40 years, China＇s criminal rules of law construction and criminal law legislation have made great progress. The Criminal Law enacted in 1979 is the first criminal code of New China. The new Criminal Law enacted in 1997 is a relatively systematic and perfect code. Up to now, the Criminal Law of 1997 has 10 criminal law amendments and 13 legislative interpretations. Reviewing and summarizing the devel- opment, achievements and shortcomings of the two decades before and after the new and old criminal law is conducive to the criminal law rule to play a more important and positive role in the active participation in social governance and human rights pro- tection in the future practice of comprehensively governing the country according to law.
