“三治”社区治理体系建构的民族制度伦理基础——基于云南少数民族村落社区的实证调查

Moral Foundation of Ethnic Systems for Constructing Community Administration System of Autonomy,Rule of Law and Rule of Morality

少数民族制度伦理均是本民族在日常公共生活中依据民族成员的利益需求而形成,具有族群内生性、以族群利益为制度伦理常规效及范围、以族群认同为制度伦理有效运行的根本保障、以"圣灵"敬畏为族群公共生活的整合基础等特质。少数民族制度伦理在社区成员的生活秩序维持、利益分配、社区公共参与等方面起着重要作用,它是少数民族村落社区"德治"的主要来源。少数民族村落"三治"(即自治、法治、德治)社区治理体系的建构,必须在民族制度伦理这一"生存基础"上展开。

The system morality of ethnic minorities has developed in the daily public life of the very nationality in accordance with the interests and demands of the members. With ethnic endogeneity, it takes system morality as its regulation and scope based on the interest of the very ethnic group, the ethnic identity is fundamentally guaranteed by effective operation of the system, the awe of ＂holy ghost＂ is the integration base of their public life. System morality of ethnic minorities has played an important role in life order maintaining, interest distribution and public community participation, and is the major source of ＂rule of morality＂ in village communities of ethnic minorities. The community administration construction of ＂triple administration＂ （autonomy, rule of law and rule of morality） in villages of ethnic minorities must be done on the ＂survival base＂ of ethnic system morality.
