收买被拐卖的妇女、儿童罪探析——以《刑法修正案(九)》为视角

Analysis on the Crime of Purchasing Abducted Women and Children——From the Perspective of the Criminal Law Amendment(Ⅸ)

《中华人民共和国刑法修正案(九)》对刑法第二百四十一条第六款进行了修订,加大了对收买妇女、儿童罪中收买者的处罚力度。刑法理论及司法实务需要我们以刑法修正案(九)为视角对收买被拐卖的妇女、儿童罪进行进一步的探究。因此,我们需要对此次修改的合理性、不足之处进行分析,并结合司法工作实践给出自己的修改建议。一方面,笔者赞同增加对收买者的处罚力度;另一方面,笔者认为,针对目前屡禁不止的拐卖妇女、儿童事件,单纯地加大对收买者的处罚力度是否能够很好地达到遏制拐卖妇女、儿童事件的发生,还需要进行进一步的探讨。另外,笔者也对司法工作实践中收买成年男性的行为发表自己的拙见。

The Criminal Law Amendment （IX） of the People＇s Republic of China amended the Article 241,paragraph 6 of the Criminal Law, and increased the penalties for the buyers of purchasing abducted women andchildren. In order to meet the requirements of the criminal law theory and judicial practice, it is necessary tomake further exploration on the crime of purchasing abducted women and children from the perspective of theCriminal Law Amendment （IX）. Therefore, we need to analyze the rationality and deficiencies of this revision, andprovide suggestions for the revision in combination with judicial work practices. On the one hand, the authoragreed to increase the penalties for the buyers; on the other hand, the author believed that it should be furtherdiscussed whether the crimes can be well prevented simply increasing the penalties for the buyers. In addition,the author also made some suggestions of the behavior of buying male adults in judicial practice.
