医疗行业商业贿赂问题浅析

Analysis on Commercial Bribery in Medical Industry

医疗领域收受贿赂已经成为该行业的的普遍现象,这一现象严重损害医院所担负的救死扶伤的形象,加剧医患之间的矛盾,使得医疗纠纷增多。伴随着国家对商业贿赂问题的惩治力度加大这一大背景,探究我国在医疗领域商业贿赂问题的立法以及司法实践的基础上,笔者对司法实践过程中所涉及的问题进行总结后,结合国外先进的经验,最后提出对于规范医疗行业商业贿赂犯罪的几点建议,目的致力于有效打击医疗领域的商业贿赂犯罪。

Taking bribes in medical field has become a common phenomenon in the industry. This phenomenonhas seriously damaged the image of the hospitals＇ life-saving, exacerbated the contradiction between doctors andpatients, and increased medical disputes. With the background of strengthening the state＇s punishment forcommercial bribery, this article explored the legislation and judicial practice of commercial bribery in medicalfield and summarized the problems involved in judicial practice process. Finally, with the advanced experience offoreign countries, this article put forward some suggestions for regulating commercial bribery crimes, so as toeffectively fighting the crimes in medical field.
