制定我国《基因安全法》的重点与难点

基因科技发展给人类生活带来便利的同时,也使人类基因安全受到了前所未有的挑战。基因安全是指人体基因处于不受人类不当活动干扰、侵害、威胁的正常状态。怎样才能使基因科技的发展与基因安全的保障之间保持一种动态的平衡,已成为法学面临的重大课题。我国基因安全领域法律严重供给不足,为保障基因安全,需要制定一部专门的《基因安全法》。知情同意制度、成果分享制度、基因技术开发控制制度、国家监管与授权许可制度、基因安全风险评估制度、禁止滥用制度等是《基因安全法》的重点。

While the development of genetic technology has brought huge convenience to human life, the human gene security is suffered from more challenges than ever. Gene security refers to the normal state in which human genes are not interfered with, invaded or threatened by human improper activities. How to maintain a dynamic balance between the development of genetic technology and the protection of gene security has become a major issue in law. In China, the law in the field of gene security is seriously in short supply. In order to ensure gene security, it is necessary to specially enact the Gene Security Law. The informed consent system, the results sharing system, the genetic technology development control system, the national mgulatory and licensing system, the gene security risk assessment system, and the prohibition of abuse system arethe focuses of the Gene Security Law.
