对我国卫生行政处罚自由裁量权行使困惑及对策探讨

卫生行政管理内容纷繁复杂、体系庞大,监督执法过程中自由裁量权在是否处罚、何种处罚以及处罚幅度等方面的行使具有一定的困难。在既有卫生行政处罚自由裁量标准下,规范本身的缺陷、执法人员的法律认知不足和执法过程的艰难都使得自由裁量的行使不能顺利进行。对此应从执法依据、执法人员两方面出发,抓紧执法实际情况,完善卫生执法自由裁量权的基准,保证自由裁量的正确实施和卫生执法的有效进行。

There has complicated content and system in health administration. Some difficulties of discretion exist in the process of law enforcement. Based on the＇existing discretion standard, the implementation of discretion is influenced by the defect of standard, lack of cognition of law - enforcement personnel and the difficulty of law enforcement process. It is suggested to improve the discretion of law enforcement in health administration from the basis and personnel of law - enforcement.
