试论青少年慈善教育的实施路径与法律保障——受香港卖旗活动的启发

Discussion on the Implementation Routine and Legal Protection of Charitable Education on the Youth——Inspired by the Flag Sale Activity in HK

根据《慈善法》第88条规定,国家应承担积极作为的义务,采取适当措施培育公民慈善意识,其中还着重指出了学校负有在教育教学过程中弘扬慈善文化的职责。这一对慈善信仰传承与慈善理念养成来说至为重要的制度设计,在现实生活当中基本处于投闲散置的境地,被当作展现姿态的宣示性法律条文束之高阁。然而,香港利用卖旗活动有力推进慈善社会建设的历史经验,却清楚表明这是一个极大的认识误区,政府有关部门与教育机构应该鼎力合作,通过优化实施路径与提供法律保障,让青少年人有机会通过亲身实践来了解慈善、体验慈善与享受慈善,才能让慈善真正成为薪火相传的事业。

According to the Article 88 of the Charity Law of PRC,the state shall be liable for cultivating its citizens＇ awareness of charity. In particular,schools shall incorporate notions of charitable culture within their syllabuses. However,this important mechanism does not make any progress in the real life,because people regard it as just a slogan. In fact,it is a terrible misunderstanding,in light of the experience that HK successfully utilized flag sale activities to promote the realization of charitable society. It indicates that government and educational institutions shall co-operate tightly to improve the implementation routine and provide legal protection,in order to offer the youth opportunities to understand,experience and enjoy charity,which may make charity last forever.
