“电脑审判”的利弊分析

Advantages and disadvantages of “Computer” trial

为响应司法改革的号召,基于山东临淄法院提出的电脑量刑的先例,许多法学家提出了"电脑审判"这一新型的科技化审判方式。这种新兴的审判方式是否适合现在的司法现状?又是否能够公正高效的审判案件?从审判效率、判决公正、社会现状几个方面分析了电脑审判的利与弊。分析认为,虽然电脑审判能够在一定程度上提高审判效率,能够在一定程度上遏制法官的自由裁量权,但是存在的弊端远远超出了它所存在的些许优点,所以电脑审判的可行性不高,要将其投入实际司法审判中,还需要进一步的探索和斟酌。

In order to respond to the call of judicial reform, there are precedents of computer sentencing pro- posed by Shandong Linzi court, and many jurists put forward a new type of scientific and technological trial of ＂computer trial＂. Is this new judicial approach suitable for the present judicial situation？ And whether it can be fair and efficient trial cases？ This paper analyzes the advantages and disadvantages of the computer trial from the aspects of trial efficiency, judgment justice and social status. Through the analysis, the author thinks that al- though the computer trial can improve the efficiency of the trial to a certain extent, and it can curb the judge＇s discretion. But the shortcomings of ＂computer trial＂, far more than its advantages, so the feasibility of computer trial is not high.To put it into the actual judicial trial, there are much work to be done to explore, and consider.
