谈生态环境损害赔偿的法理依据与制度抉择

我国现阶段面临的生态修复压力、环境法律制度的缺位等问题决定了建立生态环境损害赔偿制度十分必要。新施行的《生态环境损害赔偿制度改革方案》仍需从归责原则、起诉主体资格、赔偿责任主体、赔偿范围等方面予以完善。

At present, problems such as the pressure of ecological restoration and the absence of environmental legal system and other issues make the establishment of Eco-environmental damage compensation system necessary. The newly implemented ecosystem damage compensation system reform program still needs to be improved in some aspects: the principles of attribution, the subject of prosecution and compensation as well as the scope of compensation.
