Natural Resources Damage Prevention and Treatment Law in Environmental Protection Law

环境保护法是在环境损害实际发生之后产生的一个法律部门,是救治环境已经发生的损害的法律。作为环境保护法的资源法是环境损害防治法的一个分支,即"自然资源损害防治法"。自然资源损害防治法是预防、减轻资源损害,实现资源接续,恢复可再生资源再生能力的法律,其基本功能是防治资源损害。可以给我国的自然资源损害防治法梳理出一个由4门31种(类)的资源损害防治法构成的体系。但它不是一个坚强的法律体系。支持这个体系的包括《土地管理法》《森林法》《草原法》等在内的那些法首先是行政法,与自然资源损害防治有关联的法,而非专门的自然资源损害防治法。自然资源损害防治法要想真正起到防治自然资源损害的作用,必须改变在资源行政法中被"涉及"的局面,按照防治自然资源损害的需要,按照自然资源损害防治法的法理开展建设。

The system of China＇ s natural resources damage prevention and treatment law can be divided into 4 parts and 31 categories,but it＇ s not a strong system. The laws to support this system firstly are administrative laws including land administration law, forest law, and grassland law, and laws relating to prevention and treat of natural resources damage, but not specialized natural resources damage prevention and treatment law. Only through changing the situation of shortage of specialized natural resources damage prevention and treatment law,meanwhile conducting the construction of legal system in accordance with the need to prevent and treat natural resources damage and in accordance with the theory of natural resources damage prevention and treatment law,the natural resources damage prevention and treatment law will really work.
