“一带一路”背景下我国国际商事法庭的运行

The Construction of International Commercial Court in China from the View of Belt and Road Initiative

国际商事法庭是我国"一带一路"争端解决机构的组成部分,与仲裁机构、调解机构一起为建设"一带一路"提供法治保障。世界范围内出现的国际商事法庭设立浪潮为我国从组织架构、运行机制、法律适用、判决执行等方面设计和运作国际商事法庭提供了经验和借鉴。我国国际商事法庭在现行制度框架内,于审级设置、专家委员会、外国法查明、境外证据材料、取证及质证方式、与调解和仲裁的衔接、信息化平台建设上进行了有限的革新,但在管辖权、法官任免、诉讼程序上仍保持与普通人民法院一致的实践。立足于"一带一路"国际商事纠纷解决中心的整体定位,走差异化、特色化的发展道路是我国国际商事法庭成功运行的方向。

The international Commercial Court is an integral part of dispute settlement agency for Belt and Road Initiative in China, which, together with arbitration agencies and mediation agencies, provides legal protection for Belt and Road Initiative construction. The wave of establishment for international commercial courts around the world has provided experiences and reference for China to design and operate international commercial courts from the aspects of organizational structure, operation mechanism, law application and judgment execution. International commercial court in China within the framework of the current system, innovates limitedly in the trial level setting, the committee of experts, ascertain foreign law, the evidence materials, forensics and cross-examination, and the mediation and arbitration of cohesion, information platform construction,but still remain the practice consistent with ordinary people＇s court on the jurisdiction, the judge to appoint or remove and proceedings. Based on the overall positioning of international commercial dispute settlement center for Belt and Road Initiative, the successful operation orientation of China＇s international business court is to take a differentiated and characteristic development path.
