罪刑法定原则是反对罪刑擅断的法治成果,是当代刑事立法、刑事司法应当遵循的基本原则。按照党的十八届四中全会提出的关于"健全落实罪刑法定"原则法律制度的要求,以醉驾致人死亡案件适用"口袋罪名"为切入点,探讨研究罪刑法定原则的现代法治价值和刑事立法、刑事司法坚守罪刑法定原则问题,展望新时代中国罪刑法定原则法律制度的健全落实。

According to request to perfect and sound implement the legal system of the principle of nullapoena sine lege made by the Fourth Plenary Session of the 18 th Central Committee of the Communist Party of China,taking Pocket Charges applied to death caused by drunk driving as a starting point,discuss and study the principle of nullapoena sine lege’s value of rule of law in modern times and questions for sticking the principle of nullapoena sine lege in criminal legislation and justice,and forecast perfect and sound implementation of the legal system of the principle of nullapoena sine lege in the new era of China.
