商標顯著特徵之司法判斷——以“小肥羊”商標行政糾紛案件爲視角

Judicial Judgment on Trademark Distinctiveness——Based on an Administrative Dispute over “Little Sheep”

引言P999年、2000年先后有酒店、烤肉馆在第42类备办酒席、餐厅等服务上申请注册包括“小肥羊”文字及图形的商标，商标局均不予批准。内蒙古小肥羊公司于2001年申请注册“小肥羊LITTLE SHEEP及图”组合商标（以下简称涉案商标），商局经初步审定后予以公告。

Introduction In 1999 and 2000, there were applications filed by ho- tels and barbecue restaurants for the trademark, ＂小肥羊＂ and device （which means little sheep）, in respect of such services as providing catering services and restaurants in Class 42. None of them were approved by the China Trade- mark Office （CTMO）. Inner Mongolia Little Sheep Catering China Co., Ltd. applied for a combination mark （hereinafter referred to as the mark in suit）.
