文本与数据挖掘的版权问题——法律适用障碍和图书馆的版权立场及博弈策略

Copyright of Text and Data Mining——Legal Obstacle and the Position and Game Strategies of Library

相对于其他众多社会组织,图书馆在对数据的掌控和开发利用方面具有明显优势,是文本与数据挖掘技术重要的应用主体之一。随之而来的版权问题却成为图书馆利用文本与数据挖掘技术从事抽取、关联、分析、研判数据服务的法律障碍。对此,国际图书馆界表达了鲜明的版权立场,并为维护公共利益与权利人展开了艰难而富有成效的权利博弈,具体策略包括:开宗明义、锲而不舍、戮力同心、针锋相对、求同存异等。

Compared to other social organizations, library has obvious advantages in terms of data control and exploitation and it is one of the application subjects of text and data mining （TDM）. The copyright issue is a legal obstacle for libraries to apply TDM techniques to data extraction, correlation, analysis and research. For this, the international library community has made clear of its position on copyright and has waged the difficult but effective fights game with the fight holders for public interest. Include： taking the position,being determined,standing as one,confronting face to face,and seeking common ground and reserving differences.
