在我国,云计算和大数据等技术的进步使得共享经济得到了前所未有的发展。网约车作为共享经济的一分子,在其合法性地位被确定后,行政规制就成为对其监管的主要手段。实践中,对于网约车的价格规制和数量规制在一定程度上限制了这一新经济业态的发展,准入规制服务和安全规制涉及的法律规范制度也相对呆板。对此,应建立多元化规制主体互动机制,健全网约车行政规制方法体系,以此使网约车的行政规制更具合理性,进而促进网约车的发展。

With the development of cloud computing and large data technology in China,sharing economy and online car-hailing has been developing unprecedentedly.With the confirmation of the legal status of the online car-hailing,the administrative regulation has become the main means of the supervision of the online car-hailing,and the method of perfecting the administrative regulation is an important part of the online car-hailing supervision.The improvement of ad- nfinistrative regulation is an important part of network supervision.The administrative regulation method of the online car- hailing is different from the regulation of the traditional taxi.The price regulation and the quantity regulation restrict the development of the new economy.The admittance regulation and the legal system of the service safety regulation are rigid.In order to promote the development of the new mode of business,we should establish a diversified interaction mechanism,enhance the rationality of the content of the administrative regulation,and perfect the administrative regula- tion method system.
