试论我国污染物排放标准内容的强制性

Discussion on the Coerciveness of the Content of China's Pollutant Discharge Standards

我国污染物排放标准的作用不断提升,内容的范围不断扩大,但部分内容的强制执行缺乏法律依据支撑。论文回顾排放标准的发展历程,从标准内容的依据、义意、目的和执行等角度分析其法律效力,并结合当前国家环境标准改革的需要,提出排放标准中条文的性质,增强排放标准的规范性和透明度的建议。

The role of China＇s pollutant discharge standards has been constantly upgraded, and the scope of the content has been expanding,but the enforcement of some of the content lacks legal support. This paper reviews the development of emission standards and analyzes their legal effects from the perspectives of the basis, meaning, purpose and implementation of the standards, and combining with the needs of the current national environmental standards reform, it puts forward some suggestions on the nature of the provisions in the emission standards and the enhancement ofthe standardization and transparencyofthe emission standards.
