北京市森林生态补偿法律政策实践

On the problems of Beijing forest eco-compensation legal mechanisms and policies practice

【目的】为了进一步明确森林生态补偿的方向与法律政策调整思路。【方法】运用实证调查与文献分析送给。【结果】北京市森林生态补偿法律政策调整能够在一定程度上体现森林生态服务付费,但也存在补偿范围过窄、补偿主体与受偿主体单一、补偿标准偏低、补偿资金来源渠道有限、森林管护人员存在年龄偏大等问题;指出北京市森林生态补偿问题的解决需要构建和完善相应的生态补偿法律制度。【结论】通过立法政策调整来扩大北京市森林生态补偿范围,将平原地区所营造的公益林纳入森林生态补偿范围;进一步完善北京市森林生态补偿各项法律制度。

This article focuses on the problems of Beijing forest eco-compensation legal mechanisms and policies practice, on which will be helpful to indicate the adjustment direction of legal systems and policies. By the empirical research and literature review methods, the new legal mechanisms and policies of Beijing forest eco-compensation can reflect the payment of forest ec- ological services to a certain extent, and some problems are found, including the narrow scope of Beijing forest eco-compensation, non-diversified implementing agencies and beneficiaries, low compensation standard, limited sources of compensation funds, old and low-educated workers of forest protection and management etc. All ecological forests in Beijing, which locate either in mountainous area or in plain area, should he in the scope of forest eco-compensation no matter they are owned by indi- viduals or by collective.
