我国实施建筑节材的法律激励与强制措施研究

A Study on the Legal Incentive and Compulsory Measures to Implement the Building Material Conservation and Recycling

建筑节材在我国的推行面临诸多挑战,而现有针对建筑节材的研究,多集中在节材的技术措施、标准及评价领域,节材的法律研究少且多为间接研究。通过分析我国现行的节材法律激励与强制措施实施现状及不足,提出制定多样的激励措施,建立全面的强制措施体系的建议,旨在为建筑节材在我国的推广和发展建言献策,为我国节能减排、削减建筑业能耗、环境保护,实现建筑业和建材工业的绿色、低碳和循环发展提供可借鉴的参考意见。

The implementation of the building material conservation and recycling in China is faced with many challenges. The present researches of this matter are concentrated in the field of technical measures, standards setting, and evaluation making of the materials conservation. Thre are few legal studies and direct researches. Analyzing the current situation and the deficiency in the legal incentive and compulsory measures to conserve and recycle the building materials, this article proposes to set up a variety of legal incentives and a comprehensive system of legal compulsory measures. It aims to offer advices to promote the conservation and recycling of building materials in China, and provide reference for the energy conservation and emission reduction, the reduction of energy consumption in the construction industry and the protection of the environment in order to realize the given, low-carbon and cyclic development of both the construction industry and building materials industry in China.
