环境生态修复责任落实是当下的一个热门问题,江西省进行了广泛的实践和探索,但有两个问题迫切需要解决:如何进行生态环境损害认定和修复责任界定。对此,需要运用法律文本,并结合我省的司法判例,对"损害"和"修复"深入分析,用两步走的思路来解决这个问题:一是剖析损害的客体,把握其本质;二是认定损害的程度,把握量化的方法。准确认定损害客体、量化损害的程度,才能科学适用修复范围、标准、方式,以实现落实责任人的生态修复责任。

The implementation of environmental responsibility for ecological restoration is a hot issue at present.Jiangxi Province has also carried out extensive exploration in practice,but there are two problems that need to be solved：the identification of ecological environmental damage and the definition of responsibility for restoration.In this regard,it is necessary to use legal texts and combinejurisprudence in our provincial to analyze“damage”and“repair”in depth.There are two steps to solve this problem：one is to analyze the object of damage and grasp its essence;The second is to determine the extent of the damage and grasp the method of quantification.Only by correctly identifying the object and quantifying the extent of damage can we scientifically apply the scope,standards and methods of restoration to realize the responsibility of ecological restoration of the responsible person.
