跨国网络犯罪刑事管辖权冲突的解释与规范——以“一带一路”为分析背景

On Interpretation and Specification of the Conflicts in Transnational Cybercrime Criminal Jurisdiction: An Analysis Based on "the Belt and Road"

通过对网络犯罪的概念及特点、刑事管辖权冲突的阐述及境外国家或地区相关立法和实践方面的分析,发现"一带一路"背景下跨国网络犯罪刑事管辖权存在传统刑事管辖权规则难以适用、犯罪界定和追诉困难、新刑事管辖权规则难以建立等困境,应采取多种管辖原则并用、实际控制优先、以经济往来促进问题的解决、缔结网络犯罪国际公约、强化信息共享平台建设和国际刑事司法协助的方式构建跨国网络犯罪管辖新机制。

An analysis with regard to cybercrime＇s conception and characteristics, elaboration of the conflicts in criminal jurisdiction, the related legislation and practice in extraterritorial countries and regions reveals that under the background of ＂the Belt and Road＂, transnational cybercrime criminal jurisdiction wienesses difficulty in application of traditional criminal jurisdiction regulations, crime definition and prosecution, and development of new criminal jurisdiction regulations. Accordingly, efforts need to be made to establish a new mechanism for transnational cybercrime criminal jurisdiction in form of carrying on integrated application of multiple jurisdiction principle, giving priority to actual control, facilitating problem solving through economic exchanges, establishing international conventions on cybercrimes, and strengthening construction of information sharing platforms and international criminal justice assistance.
