网约车新政实施的法治化研究

On the Rule of Law through Execution of the New Policy Of Network Cars

网约车在中国已经合法化,但是。《网络预约出租汽车经营服务管理暂行办法》与各地出台的网约车细则,仍存在需要完善之处。存在的问题主要包括地方立法超越上位法,地方细则不符合公平市场和保护生态要求等。鉴于此,应善用法律授权,恪守市场公平和环境法有关规定,从而实现网约车法治化。

Network cars have been legalized in China. However, the Interim Measures for the Management of the Operation and Service of the Network Booking Taxi Service and the deep and wide joint formulation of the ＂network about the new deal with the car＂ still exist, such as the local legislation transcending the upper law, the local rules and regulations do not conform to the fair market and the protection of the ecological requirements. In view of this, we should make good use of legal authorization, abide by the relevant provisions of market fairness and environmental law, realize the legalization of Internet dating vehicles.
